Hey guys i think i did a bad thing

I drove all the way down to Hoppers Crossing (30 mins) to get my pair of Hertz speakers. When i was there it sounded beautiful on the demo board and when i came to pay for it, the guy told me it's out of stock.

Don't get me wrong the guy was a champ and gave me good advice and all but... but he didn't have any and he recommended me some earthquake 6.5 focus component set. On the demo board it sounded pretty good, (but anything in that price is better than the pioneers i have) but i still feel they weren't as good as even the cheapest hertz components.

Now i'm desperately hoping it will sound alright in my car, magna ts, but on the board the tweeters seemed to be a bit 'bright'. So my main worry is the tweeters.

My question is what do you think, should i keep the earthquakes which i got discounted by quite alot or should i return them and get the basic hertz i've been hoping for? Am i even allowed to return them? It's not opened or anything.

On the box it only says max 600 watts, no rms or nothing not even on the website, but i'm planning on running it with 150rms per channel MTX amp

sometimes on the reciept is says "refund / return policy"

under the trade practices act you are allowed to return is unless its been opened. if they wont give you money back, they have to atleast give you a credit voucher

TPA also does not have provision for exchange/refund if the reason is simply change of mind. Re Earthquakes though, they are loud and that's about it. When it comes to front stage speakers I prefer European speakers rather than American or Japanese.

With the Hertz, on the crossover there are 3 attenuation settings for the tweeters, 0db, -2dB, and -4dB.

No your not screwed, They ahve absolutly no choice but to exchange at the very least the speakers if the box has been unopened. They can even have no return policy but it means nothing, By law you are allowed to at least exchange goods for the same value.

When is a business required to give a refund?
A customer has a right to ask for a refund if any of the implied conditions have not been met. This means a refund would be in order if the goods:

* are faulty (even when the fault only becomes obvious after use)
* are unfit for their purpose – which means they won't do what the customer reasonably expected them to do
* don't match the description or sample shown
* came with an extra promise about refunds.

A business may offer to repair, exchange or provide a credit note. However in these circumstances the customer does have the right to insist on a refund.

Note: Goods that are "on sale" must be treated in the same way as ordinary stock when determining a refund. The implied conditions cover them regardless of their sale status.

When can a business choose to give a refund?
It is a trader's choice to refund if the customer:

* has simply changed their mind
* discovered the goods cheaper elsewhere
* knew about a particular fault before buying the goods
* damaged the goods by using them in a way they were not made for
* does not provide a proof of purchase (receipt or bank statement)

If a store chooses to refund customers in these circumstances, their refund policy is going above and beyond what the law requires.

The customer's obligations
If a customer asks for a refund, they should:

* Report the fault and return the goods within a reasonable time. (What is reasonable will vary according to price and the way the goods are described)
* Provide details of the fault and their chosen remedy
* Provide proof of purchase
* Stop using faulty goods until they can be returned

Well do you think i got a good deal because i'm comparing these to the 229 hertz, not the 349 ones. so earthquake vs $229 hertz, which do you think is better? the earthquakes retail for around 370 or thereabouts

if the tweeters are bright and thats ur main concern, u should be able to control the tweeter gain somehow. theres usually a level setting for them. have a look

I'm happy now, i've just exchanged them for hertz hks splits... now i can't wait to get them and throw them in
