If it passes noise and emissions tests then it's ok.
But the thing is do you have the money/time to get it tested?

you can get permits from teh pits for them - and they check to make sure they are ok - i got a permit for mine (not that the cops can see mine - burried under the front of the front spoiler)

after market air intake systems can be permitted by teh department of transport (the pits) if they deem it safe as it is not affecting the emissions as it is modifying the air going into the engine not comig out of it - and as long as it isn't dangerous - ie loose and floating around.
Just go to where you normally would to get a yellow sticker off and talk to them about it!

In a word, illegal unless in a sealed box with breather attached to the engine as the pod filter is oiled and yes you guessed it, the good ol epa recon there are exessive hydrocarbon emmissions let off by the oil in the pods.

Im sure this varys from state to state but dispite what police and other people will tell you, in WA they ARE LEGAL.
From what the guys down at the pits have told me you are allowed to do whatever you like to the induction system as long as you don't tamper with the oxygen (in our case MAS) sensors as this is what sends emmissions up the the spout.

Blake, not flaming you or anything but just one word of warning, the EPA is a national body, there are national road laws now and if the guy down the pits is willing to pay the fine all and good however under National EPA laws oiled pod filters not contained in a sealed air box are illegal due to what I posted above and also the to the risk of fire in an engine bay.
I will find the section at some stage when I have time and post it.
In general the guy from the EPA will not give a hoot what the guy at the pits said as they over rule in relation to emissions and enviromental issues.
Perhaps the road authorities will have no problems with them but the others might.

Yeah, gotta remember there's more than one authority to worry about on the roads.

Agree with Mal...
Those EPA blokes have the power to sticker your car EVEN without stopping you.. Eg. Some EPA Bloke might just hear your "ZORST" and all he/she needs to do is to take down your number and off to the pits u go...

In Melbourne there is a large cruise reg, after some cruises especially if the idiots that always seem to rock up do cause trouble it is not rare for many ppl to get a compulsary invite to the vic roads for an inspection and of course the EPA attend the party to add some spice.

Oh i agree when in regards to the EPA. However if you do get unlucky enough to get yellowed. You can take your car through the pits at the Fremantle Transport Authority they won't have a problem with is as long as you haven't modified your oxygen sensor.
As long as I can get through the pits and my insurance company won't dis-own me it doesn't bother me whether its illegal or not.

What the pits say is great however EPA defects can only be removed by the EPA not the Transport and road safety guys.
