PUBLIC COMPUTER CONDITIONS OF USE

Wyndham City Council makes public computers available to all members of the Wyndham Library Service for personal use only. By using a public computer, you agree to be bound by these conditions of use.

  1. USERS
    1. To use a public computer, you must have an active membership with the Wyndham Library Service.
    2. If you are aged under 18 years of age, you must have your parent or legal guardian's consent to use the public computers.

  2. SESSIONS
    1. Once you have logged on to your session, you will be able to use the public computer for 30 minutes. If there are no other users booked in or waiting to use the public computer, you may extend your session by a further 30 minutes.
    2. You may use the public computers for a maximum of 600 minutes per day.
    3. All sessions must end 5 minutes before the library's closing time.

  3. USE OF PUBLIC COMPUTERS
    1. The library is a public space. You agree to be considerate of other users of public computers and of library patrons generally when using a public computer, including by using headphones for any audio you may play during your session.
    2. You are responsible for bringing any equipment you may require during your session, such as headphones and compatible storage devices (e.g. USB, portable hard drive).
    3. You acknowledge and agree that Council staff may, subject to availability, be able to provide limited assistance to you during your session, but may be unable to provide detailed or technical support.
    4. You must not download and install any software or otherwise interfere with the computer's operating system.
    5. You must not use a public computer to:
      • (a) access, view or download any illegal content;
      • (b) engage in any illegal activity;
      • (c) send emails, messages or other electronic communications which are excessively large, unsolicited, unwanted, obscene, spam, or are intended to bully or harass another person; or
      • (d) attempt to crash or interfere with any computer, by way of viruses, malware, denial of service attacks or otherwise.

  4. END OF SESSION
  5. You acknowledge and agree that:
    1. Council recommends that before your session ends, you log out of any accounts that you have logged into and that you delete any personal information that you may have saved onto the computer, including documents and passwords;
    2. when your session ends, you will vacate the computer station and remove your personal belongings; and
    3. anything that you have saved onto the public computer will be deleted and cannot be recovered.

  6. INTERNET
    1. Council makes no guarantee about the availability, speed or response time of the internet or any websites at any time.

  7. PRINTING
  8. You acknowledge and agree that:
    1. printing documents from a public computer will incur charges as set out on Council's website; and
    2. if you do not release your print job from the print queue by the library's closing time, it will be deleted and cannot be recovered.

  9. LIABILITY
    1. You use the public computers at your own risk and you acknowledge and agree that Council does not guarantee the security of any data that you access or transmit while using a public computer.
    2. To the extent permitted by law, Council is not liable to you for any loss, damage, claim or expense suffered, including, but not limited to, property loss or damage, personal injury and death, as a result of or in connection with your use of a public computer, except to the extent that any such loss is caused or contributed to by the negligent act or omission of Council.

  10. INDEMNITY
  11. You indemnify and hold harmless Council, its councillors and employees against all costs, claims and liability arising in connection with a breach or potential breach of these terms and conditions.
  12. BREACH
  13. Any breach of these conditions may, at the option of Council, result in your current session being terminated and/or your future use of the public computers being suspended (either temporarily or permanently).
  14. GENERAL
  15. Council reserves the right to amend these conditions at any time without prior notice.
